The following Terms & Conditions apply to participation in, and the related ticket purchase for, our developer conference code.talks (hereinafter referred to as "the event"), hosted by ABOUT YOU GmbH, as amended.
ABOUT YOU GmbH reserves the right to amend and supplement these regulations. Any amendments and additions thereto become valid by their publication on this website. We hereby ask the participants to go through these General Terms & Conditions from time to time to keep themselves up-to-date.
You can only register for the event on the event website of our ticket partner, amiando AG (Amiando AG, Sandstraße 33, 80335 Munich). On the event home page, participants have to click on "Register" or "Tickets" to get to the registration page for the event. Here, participants select the desired number of tickets and click on "Continue". In the next step, the participants enter their personal information int he registration form. By clicking on the "Continue" button again, each participant is asked to provide his billing address within the scope of collecting the "buyer and ticket details". After this, the payment options are shown. Each participant has the possibility to choose between "direct debit", "credit card" or payment via "PayPal". In addition, there is a choice of shipping methods. In a fourth step, the stored data can be checked and the ticket purchase can be confirmed by clicking on "Buy Tickets". The contract for participation in the event does not come into force until Amiando AG has confirmed the registration in writing by sending an e-mail to the participants. Any changes and/or supplements to the contract require the written form. This shall also apply to a waiver of the writtem form requirement.
There are three different payment options to pay for the tickets to the event:
The participants can pay by "direct debit". To do so, they are asked to provide their bank details (account holder, account number, bank code and name of bank) in the third step of booking a ticket. The account you indicated will then be debited by the amount of the ticket price over the next few working days.
The participants can also pay by "credit card" (MasterCard or VISA). Each participant can enter his credit card information under "Payment Options" in the third step of booking a ticket. The respective credit card account will then be charged in the amount of the ticket price including any shipping costs over the next few days.
In addition, participants can use "PayPal" to pay for their tickets. By choosing "PayPal" under "Payment Options" in the third step of booking a ticket, they are directed to the website of PayPal (Europe) S. à .r.l. & Cie, S.C.A. PayPal (Europe) S.à r.l. & Cie, S.C.A. 5th Floor 22-24 Boulevard Royal L-2449 Luxembourg Authorized representative: Renier Lemmens On the above website, the participants are guided through the process of paying via "PayPal". The promotional codes are sent individually by ABOUT YOU GmbH. There is no legal claim to such code, which is only a discount. The promotional code must be entered by the participants in the registration form before clicking on "Continue" by clicking the button "Click here to enter the promotional code". The system automatically recognizes the promotional code and factors in the discount in calculating the final ticket price.
a. Cancellation notice
Participants may cancel their registration within two weeks in writing or by phone without specifying any reasons for the cancellation. They can do so by sending an e-mail with the ticket ID or by calling the hotline below. Here is the contact information:

The cancellation period begins upon receipt of these instructions in text form, but not before conclusion of the contract. The deadline also does not begin until ABOUT YOU GmbH has met its obligations under Art. 246 Sect. 2 in conjunction with Sect. 1 (1) and (2) of the Introductory Act to the German Civil Code (EGBGB) as well as its obligations under Sect. 312 g (1) sentence 1 of the German Civil Code (BGB) in conjunction with Art. 246 Sect. 3 EGBGB. To meet the deadline, it is sufficient to send the cancellation notice in due time.
b. Consequences of cancellation
In the case of a valid cancellation, both parties have to return the received goods/payments, including any benefit (e.g. interest) drawn from them. If the participant in unable to return and/or surrender the received goods as well as benefits (benefits of use) in whole or part or can only return the goods in a deteriorated condition, the participant shall compensate ABOUT YOU GmbH for the loss of value to the extent that the use or deterioration of the goods is due to their handling other than what is necessary to ascertain the nature and functioning of the goods. "Ascertaining the nature and functioning of the goods" shall mean the testing and trying out of goods to the extent possible and usual in a retail store. Goods that can be sent as a package must be sent back to us at our risk. The participant shall bear the shipping costs if the delivered goods correspond to those ordered, otherwise the return shipment shall be free of charge for the participant. Any obligation to reimburse payments must be met within 30 days. This period begins for the participant at the time his cancellation notice is sent, for ABOUT YOU GmbH at the time it is received.

c. Expiry of the right of cancellation
The right of cancellation expires prematurely, if ABOUT YOU GmbH has started providing the service with the express consent of the participant prior to the end of the cancellation period or if the participant himself has arranged for the provision of the service.
Registration for the event is limited to 300 participants per event day. Any registration can therefore only be allowed within this limit. If 300 people have already registered at the time of registration, you will no longer be able to register via the registration form.
Unless a material obligation arising from the contractual relationship is concerned, ABOUT YOU GmbH and its vicarious agents shall only be liable for damages that demonstrably resulted from an intentional or grossly negligent breach of duty within the scope of the contract and which may still be defined as typically foreseeable damages. Neither do we assume any liability if the event is delayed or cancelled entirely due to force majeure. The same applies to unforeseeable cancellations of speakers. ABOUT YOU GmbH also assumes no liability for consequential damages arising from any possible incorrect and/or incomplete content of the presentations and/or event documents.
The event participants irrevocably agree that ABOUT YOU GmbH has the right, within the scope of the event and for all present and future media, to use audiovisual imagery of the particiants without payment for any replay of the event and extending beyond the period of the event, and to create, reproduce, broadcast or permit the broadcast of such audiovisual imagery.
Lectures and event documents are protected by copyright. Rights of use can only be transferred upon express written approval thereof. The participants are not authorized to copy any licensed material that has been handed out for training and information purposes. Licensed materials are data processing programmes and/or licensed, machine-readable data bases and include the associated documentation.

ABOUT YOU GmbH would like to point out that the General Terms & Conditions of amiando AG apply in addition to its own General Terms & Conditions, and that these are therefore an integral part of the above regulations:

a. These Terms & Conditions are governed by the laws of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Provided the participant is a merchant within the meaning of the German Commercial Code or has no fixed residence at the time a lawsuit is filed, the exclusive place of jurisdiction shall be Hamburg. b. Should one or more provisions of these Terms & Conditions be invalid in whole or part, this shall not affect the validity of all other provisions. The invalid provisions shall be replaced by such valid provisions that as closely as possible reflect the intentions of the parties.
